Agreement to Terms

These Terms of Service ("Terms") govern your use of the Optimovo Voice AI receptionist service ("Service") operated by Optimovo Ltd ("we," "us," "our"). By subscribing to or using the Service, you agree to be bound by these Terms.

Service Description

Optimovo Voice provides an AI-powered phone receptionist that answers inbound calls on behalf of your business. The Service includes:

As part of the Service, we send transactional SMS and WhatsApp messages to phone numbers you designate during setup. By providing staff phone numbers, you confirm that:

Your Responsibilities

Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted operation. The Service depends on third-party infrastructure including telecommunications providers, AI processing services, and cloud hosting. We are not liable for downtime caused by factors outside our control.

Call Recording and AI Disclosure

Calls handled by the AI receptionist are recorded and transcribed. The AI agent identifies itself as an AI assistant at the beginning of each call. You are responsible for ensuring compliance with any state or local laws regarding call recording and AI disclosure that apply to your business.

Accuracy

The AI receptionist processes natural language and may occasionally misinterpret caller information. Notifications are generated from AI-processed transcripts and may contain inaccuracies. We continuously improve accuracy but do not guarantee that every detail captured will be error-free. Critical business decisions should not rely solely on AI-generated summaries.

Payment and Billing

Service fees are as agreed in your subscription or service agreement. We reserve the right to adjust pricing with 30 days' written notice. Failure to pay may result in suspension of the Service.

Intellectual Property

The Service, including its technology, design, and branding, is owned by Optimovo Ltd. Your call data and business information remain your property. We retain a limited license to use anonymized, aggregated data for service improvement.

Limitation of Liability

To the maximum extent permitted by law, Optimovo Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, lost revenue from missed or mishandled calls, inaccurate AI transcriptions, or notification delivery failures. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

Termination

Either party may terminate the Service with 30 days' written notice. We may suspend or terminate the Service immediately if you breach these Terms. Upon termination, we will cease call handling and notifications. Call records will be retained for 90 days after termination, after which they will be deleted.

Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or notification.

Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
